Terms of Use

1. Parties and Scope

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Pet Activities ("Company", "we", "us") governing your use of the Pet Activities mobile application and website (collectively, "Service") available at petactivities.com.tr.

These Terms are prepared in accordance with Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği).

2. Eligibility

• You must be at least 18 years old to create an account and use the Service.
• By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement.
• If you are registering on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorised access to your account.
• Take responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently or in violation of these Terms.

4. Subscription and Payment

The Service is offered on a subscription basis with the following plans and current prices:

• All prices include applicable taxes (KDV) as required by Turkish law.
• Payments are processed securely by iyzico Ödeme Hizmetleri A.Ş., a licensed payment service provider in Turkey.
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• We will notify you by email at least 3 days before renewal for annual plans.
• We reserve the right to change prices with at least 30 days' prior written notice. Continued use after the effective date constitutes acceptance of the new prices.

5. Free Trial

• New users may be offered a 7-day free trial for any paid plan.
• No payment information is required to start the free trial.
• If you do not subscribe before the trial ends, your account will revert to a limited free tier automatically.
• Free trials may only be used once per user.

6. Cancellation

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period. You will not be charged for subsequent periods.
• Upon cancellation, your account will be downgraded and you will retain read-only access to your data for 90 days.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable Turkish or international law or regulation.
• Transmit any content that is defamatory, obscene, fraudulent, or harmful.
• Attempt to gain unauthorised access to any part of the Service or other users' accounts.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service for commercial purposes other than as expressly permitted by these Terms.
• Upload or transmit viruses, malware, or any other malicious code.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the name "Pet Activities", logo, software, text, graphics, and the underlying technology — are owned by the Company and are protected by Turkish and international intellectual property laws.

You retain ownership of any content you submit to the Service (such as pet photos and health notes). By submitting content, you grant us a limited, non-exclusive licence to store, process, and display it solely to provide the Service to you.

9. Limitation of Liability

To the maximum extent permitted by Turkish law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Turkish law.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of Turkish courts.

Consumer disputes may also be referred to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or Consumer Courts (Tüketici Mahkemeleri) in accordance with Law No. 6502.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email and in-app notice at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
